Abstract
Al-taʿarrub baʿd al-Hijrah (returning to the Bedouin life after migration) is an important narrative and juristic topic (concept) mentioned under the major sins. This concept can serve as a juristic principle applicable in various areas such as congregational prayers (salāt jamāʿat), marriage (nikāh), jihad (holy war), the jurisprudence of politics and state, and the jurisprudence of education. It is also influential in determining the rulings on contemporary international migrations. This principle has certain ambiguities in terms of its conceptual and referential meanings. Does this concept pertain to political and legal matters or to educational and formative ones? Does Hijrah refer to physical migration or intellectual and epistemological migration? Does “Ta’arrub” have instances in the present era or not? To answer these questions, we first present the viewpoints in this regard, and to validate them, we interpreted this keyword using relevant narrations and an interpretative juristic method. The result was that “Taʿarrub baʿd al-Hijrah” is a legal-political concept referring to a Muslim’s commitment to the Islamic state, and “any departure from the land of the Islamic state under legitimate divine authority that leads to separation from allegiance and obedience and abstention from supporting and strengthening the Islamic community will be “Al-taʿarrub baʿd al-Hijrah.” Accordingly, international migrations can be divided into two categories: positive and negative.
