A Reflection on the Nature of Legislation in the Islamic Republic of Iran

Abstract
With the formal establishment of the Islamic Republic of Iran, the idea of ‘legislation based on the Divine Law (Shari ҅ah)’ gradually gained considerable strength. Despite this, the absence of a system of thought suitable and symmetrical for making a link between law and Shari ҅ah in respect of legislation has brought about certain problems and heterogeneity in the field of legal debates. This has also caused many existing structures and institutions not to be emanated from the Divine Law, which has its roots in the fact that there has been a failure to properly define and explain the implications of conventional and legal legislation. Accordingly, the main topic of this research work is to ‘examine the relationship between the current state of legislation in Iran’s legal system and the desired legislation originated in the Divine Law.’ Drawing upon the descriptive-analytical method, in the present research, an attempt has been made to conduct this comparative study of both forms of legislation to provide the necessary solution for finding the desired legislative system. The innovative nature of the present research, which has been less carefully investigated, is the insight into the lack of correct and desirable establishment of legislation based on the Divine Law, due to the lack of connection between the stage of discovering and deducing the laws of Shari ҅ah and the stage of planning based on the laws discoverd by the Muslim jurists.
