In addition to defending, some countermeasures can be essential and justifiable. A question arises here: Is the Islamic state able to organize and carry out all-out retaliatory attacks and take countermeasures against the attacks that may be launched by the enemies? In fact, the answer to the question lies in the acceptance of the permission for retaliation at the international level and in connection to the foreign relations of the Islamic state. In case the answer to the above question is positive, the second question arises: To what extent are these measures permissible and what are the possible obstacles?It seems that retaliation can be made possible as it is the case with the realms of the private or criminal law and those of the international relations and the belligerent countries (states) or movements. Despite the appropriate aspects of the matter in question, the process of exercising the rule ‘retaliation’, in respect of ‘target’, against civilians (non-military targets) and the enemy captives and in respect of ‘method’ in dealing with inhuman methods as well as the use of weapons of mass destruction may face restrictions and prohibitions. Except for the realm of creating knowledge and acquisition of knowledge of production which can serve to terrify the enemy, there might be the case when it is not permitted to retaliate. In addition, in the present situation, this very last view is consistent with the higher interests and expediencies of the Islamic system. The article at hand seeks to cast light on the issue of the process of the rule of giving permission for ‘retaliation’ by the Islamic government from the QurÞanic viewpoint as well as the restrictions and obstacles involved.}, keywords = {retaliation,Oppression,recompense,preventive retaliation,Islamic Government}, title_fa = {بررسی حدود مقابله به مثل حکومت اسلامی بر اساس آیات قرآن}, abstract_fa = {در قبال تهاجم دشمنان به کیان نظام اسلامی؛ به ویژه در محیط بین المللی، دفاع مشروع، از نخسین حقوق مسلم به شمار می‌رود. ممکن است علاوه بر دفاع، اقدامات متقابلی هم ضرورت و توجیه داشته باشد. سؤالی که مطرح می شود این است که آیا نظام اسلامی می تواند، در قبال اقدامات تهاجمی دشمن، به صورت متقابل، اقدامات تهاجمی را ساماندهی و عملیاتی کند؟ در حقیقت پاسخ به این پرسش، در پذیرش قاعده جواز مقابلة به مثل، در قلمرو بین المللی و ارتباطات خارجی دولت اسلامی است. در صورتی که پاسخ به این پرسش مثبت باشد، پرسش دوم این است که این اقدامات در چه محدوده ای، مجاز و موانع احتمالی آن کدام است؟به نظر می‌رسد مقابله به مثل، همچون حوزه های حقوق خصوصی و کیفری و در قلمرو روابط بین المللی و در مورد دولت ها یا جنبش های متخاصم هم امکان پیدا کند. به رغم وجود مقتضی در این باره، ممکن است جریان قاعده مقابله به مثل، از «جهت هدف»، نسبت به غیر نظامیان و اسرای دشمن و «از جهت روش»، در مورد روش های غیر انسانی و استفاده از سلاح های کشتار جمعی با محدودیت ها و ممنوعیت هایی مواجه باشد. به جز در ساحت دانش افزایی و کسب دانش تولید که می تواند ارهاب و ارعاب دشمن را به دنبال داشته باشد، ممکن است حکم عدم جواز جاری بشود و بعلاوه در وضع کنونی نیز این دیدگاه با مصالح عالیه نظام اسلامی نیز موافق است.جریان قاعده جواز مقابله به مثل توسط حکومت اسلامی در پرتو قرآن و بررسی محدودیت ها و موانع آن از موضوعات مطرح در نوشتار حاضر است.}, keywords_fa = {مقابله به مثل,اعتداء,جزای به مثل,مقابله به مثل پیشگیرانه,حکومت اسلامی}, url = {https://mag.rcipt.ir/article_95483.html}, eprint = {https://mag.rcipt.ir/article_95483_432845e7f1e17ac2302f17b2f686caeb.pdf} }
