The Sunni jurisprudents are also not unanimous about the issue in question. In general, in both ShiÝi and Sunni jurisprudence, there have been two differing views of the financial offences. Since the early ShiÝi jurisprudents have not been faced with the juristic (fiqhi) questions in the field of Islamic government, they have had less considerations of the governmental fiqh and taken the legal discretionary punishments [awarded by the judge] to be restricted to what the legal texts prescribe. In other words, they hold the view that the prescribed punishment can be reduced to and replaced by imprisonment and reprimand of certain kind and do not consider pecuniary punishments and deprivation of political and civic rights as illegal. However, after the establishment of the Islamic Republic of Iran, some contemporary faqihs, having made some considerations of and speculations about governmental fiqh, believe that an Islamic government can lay down laws for pecuniary punishments. In this connection, they argue for the necessity of the preservation, reorganization and consideration of the common good of the Islamic community and offer historical evidence based on the reports of the Infallible Imams to substantiate their own views. In the Sunni fiqh, there have been two theories concerning pecuniary punishments. Some say that pecuniary punishments are permissible and some believe that they are illegal and thus forbidden. Both groups have offered their own reasons, but the legitimacy of pecuniary punishments as discretionary punishment in the discipline of fiqh enjoys a stronger ground which leaves no room to doubt about it.}, keywords = {fiqhi foundations, penalty (fine,punishment), discretionary punishment, governmental rulings}, title_fa = {مبانی فقهی جریمه مالی در فقه امامیه و فقه اهل سنت}, abstract_fa = {مشروعیت جریمه مالی در حکومت اسلامی، یکی از چالش‌های جدی فقهای امامیه بوده و در فقه اهل سنت نیز این مسأله مورد اختلاف است. بطورکلی در فقه‌ اسلامی؛ اعم از فقه امامیه و فقه اهل سنت، دو ‌‌دیدگاه متفاوت نسبت به جریمه مالی مطرح است. فقهای متقدم شیعه به دلیل مواجه‎نبودن به پرسش‎های فقهی در حوزه حکومت اسلامی تأملات کمتری نسبت به فقه حکومتی داشته و تعزیرات شرعی را محدود در دایره نصوص شرعی؛ یعنی زدن کمتر از حد‌،‌‌حبس و توبیخ می‌دانسته جریمه مالی و محرومیت از حقوق سیاسی و مدنی و ... را مشروع نمی‎دانند، ولی برخی از فقهای معاصر که بعد از تأسیس نظام جمهوری اسلامی نظریه‎پردازی نموده و تأملات بیشتری درحوزه فقه حکومتی نموده‎اند، معتقدند حکومت اسلامی می‎تواند جریمه مالی را وضع نماید. در این راستا به ضرورت حفظ‌،‌ انتظام و مصلحت امت اسلامی استدلال نموده روایات و شواهد تاریخی مستند به معصوم را شاهدی برای اثبات دیدگاه خود می‎آورند. در فقه اهل سنت نیز دو نظریه مطرح است. برخی قائل به جواز جریمه مالی هستند و برخی دیگر معتقد به حرمت جریمه مالی نظر داده‎اند. ‌هر دو گروه، برای اثبات نظریه خودشان دلایلی آورده‎اند، ولی مشروعیت جریمه مالی به عنوان مجازات تعزیری در دانش فقه از مبانی قوی‎تری برخوردار است که نباید در مشروعیت آن تردید روا داشت.}, keywords_fa = {مبانی فقهی,جریمه,تعزیر,احکام حکومتی}, url = {https://mag.rcipt.ir/article_90879.html}, eprint = {https://mag.rcipt.ir/article_90879_ac6e56ca3e2bf40e3fad3f12981813b2.pdf} }
