Good or bad functions of the states in managing these events have played a decisive role in increasing or decreasing the number of victims, so it seems necessary to establish the duties of the Islamic state toward these events. Although in some researches mentions have been made to the duties of the states in this regard, this article seeks to establish the primary rule of the states’ duties toward the contagious diseases drawing upon the proofs of fiqh. Furthermore, apart from the government proofs of the guardianship of Muslim jurisconsult, the article tries to establish the states’ duties, drawing inspiration from the proofs of the necessity of prevention of constraint, the acquisition of its preliminaries, necessary measures as well as the necessity of taking care of the Muslims’ affairs. The result of the research reveals that, according to the primary rule, when the society is threatened by a contagious disease, it is incumbent upon the Islamic state to do whatever it can, to take necessary measures to prevent the spread of the disease in the society – no matter what it does may result in denying individuals’ freedom, business closure, closure of gatherings and religious ceremonies –, in order to resolve the economic problems caused by the spread of the disease and in line with the mentioned effective measures to fight disruptions.}, keywords = {contagious diseases,duties of government,jurisprudential study,primary rule,corona virus}, title_fa = {وظایف دولت و حکومت اسلامی در موضوع بیماری های مسری و فراگیر}, abstract_fa = {جامعه بشری در طول تاریخ با همه گیری‌های متعددی؛ مانند جنگ ها و بلایای طبیعی و بیماری ها مواجه شده که قربانیان فراوانی برجای گذاشته است و همواره عمل کرد قوی و ضعیف دولت ها در مدیریت حوادث در تعداد قربانیان نقش تعیین کننده داشته است، لذا اثبات وظیفه مندی دولت در قبال این حوادث ضروری است. هر چند در برخی از تحقیقات به بعضی از وظایف دولت ها در این زمینه اشاره شده، اما این مقاله با استناد به ادله فقهی، به دنبال اثبات حکم اولی وظایف دولت ها در قبال بیماری های مسری است تا با قطع نظر از ادله حکومتی ولایت فقیه و ... با الهام از ادله وجوب دفع اضطرار و تحصیل مقدمات آن و وجوب اهتمام به امور مسلمین، وظایف دولت‌ها را اثبات کند. نتیجه تحقیق آن که به حکم اولی، بر دولت اسلامی واجب است در زمان درگیری با بیماری های مسری، نسبت به تهیه مقدمات و اقدامات لازم اقدام کند، تمهیدات لازم را بیندیشد و هر کاری که مانع از انتشار بیماری در جامعه است ـ هر چند آن کار منجر به سلب آزادی افراد، تعطیلی اجتماعات و کسب و کار، تعطیلی مراسمات مذهبی شود، ـ انجام دهد، مشکلات اقتصادی و... ناشی از شیوع بیماری را از مردم برطرف کند و در راستای اقدامات مذکور با اخلال گران مقابله و مبارزه نماید.}, keywords_fa = {بیماری های مسری,وظایف حکومت,بررسی فقهی,حکم اولی,کرونا}, url = {https://mag.rcipt.ir/article_164467.html}, eprint = {https://mag.rcipt.ir/article_164467_b1c13e8b2a5c176bf0f03df6945de08d.pdf} }
