The main question of the article is ‘What are the criteria for or indexes of limiting the civil, political, social, economical, and cultural freedoms?’ Having distinguished between the “source” and “basis” of limiting freedoms, the article considers the source and the main factor in limiting freedoms is ‘law’, emphasizing on the point that limits of freedom are defined merely by law upon which both conventional system of human rights and Islamic system of human rights agree, and the difference being only in the content of the laws. On the other hand, the foundation on which law can restrict freedoms can be the following four criteria: ‘violation of individual’s freedom’, ‘public rights and national security, ‘public decency’ and ‘public orders’. Islamic legal system, in addition to these criteria or indexies just mentioned, the index of ‘violation of religious criteria’ as an important basis has been emphasized. These criteria or indexes can be internally expanded or narrowed down, provided that they do not overshadow the principality of freedom.}, keywords = {limits of freedom,public decent,Public Order,National Security,Islamic human rights,conventional human rights}, title_fa = {تحلیل معیارهای تحدید آزادی در دو نظام حقوق بشر اسلامی و حقوق بشر عرفی}, abstract_fa = {هرچند صیانت از آزادی دغدغه اصلی نظام های مردم سالار است، با وجود این، آزادی ها در هیچ نظام حقوقی به صورت مطلق به رسمیت شناخته نشده اند. پرسش اصلی این است که حدهای وارد بر آزادی های مدنی، سیاسی، اجتماعی، اقتصادی و فرهنگی بر اساس چه معیارها و شاخص‎هایی صورت می پذیرد. این مقاله با فرق گذاری میان «مرجع» و «مبنا»ی تحدید آزادی‎ها، مرجع و عامل اصلی تحدید آزادی‎ها را قانون دانسته و بر این نکته تأکید می‎کند که حدود آزادی، صرفاً به موجب «قانون» تعیین می‌شود و در این مسأله نظام‎های حقوق بشر عرفی و اسلامی هم‎داستان‌اند و تفاوت را تنها باید در محتوای قوانین جست‌وجو کرد. از سوی دیگر، مبنایی که بر اساس آن، قانون می‌تواند آزادی‎ها را محدود کند، معیارهای چهارگانه تجاوز به «آزادی دیگران»، «حقوق عامه و امنیت ملی»، «عفت عمومی» و «نظم عمومی» است. در نظام حقوقی اسلام، افزون بر این شاخص‌ها، شاخص تجاوز به «موازین شرعی» نیز به عنوان یک مبنا مورد تأکید قرار گرفته است. این شاخص‌ها متناسب با هر نظام حقوقی، در درون خود قابلیت قبض و بسط دارند؛ مشروط بر این‌که اصالت آزادی را تحت الشعاع قرار ندهند.   }, keywords_fa = {حدود آزادی,عفت عمومی,نظم عمومی,امنیت ملی,حقوق بشر اسلامی,حقوق بشر عرفی}, url = {https://mag.rcipt.ir/article_158216.html}, eprint = {https://mag.rcipt.ir/article_158216_6f59c023320c4e70c507971fb731fd8b.pdf} }
