Having mentioned different areas of protecting privacy as in creeds, physical body, residence, communication, information, the present research examines the articles 3 and 5 of the law of protection of those who enjoin the good and forbidding the evil against the Islamic Law and the Constitution. The findings of the research, while emphasizing the fact that the illegitimacy of surveillance and intrusions into people’s privacy include those measures taken to enjoin the good and forbid the evil, show that taking into account the general application of the verses and traditions concerning the question of enjoining the good and forbidding the evil, the necessity of these two obligations is not limited overtly to the abandoning of religious obligations and commiting inviolable things and no elaboration is found in the words of the Musliim jurisprudents between the abandoning religious obligations or committing inviolable things overtly or covertly. Hence, it seems that the legislator has made a confusion between the impermissibity of surveillance and universalizability of enjoining the good.  }, keywords = {enjoining the good,forbidding the evil,Privacy,Surveillance,the constitution}, title_fa = {تأملی  در حریم خصوصی و محدودساختن امر به معروف و نهی از منکر  در رفتارهای علنی از منظر فقه و قانون}, abstract_fa = {این مقاله در مقام پاسخ گویی به این پرسش است که آیا انجام فریضه امر به معروف و نهی از منکر صرفاً ناظر به رفتاری است که علنی بوده و بدون تجسس مشخص باشد یا در برخی موارد نمی توان امر و نهی را مقید به رفتار علنی و آشکار کرد. مقاله با اشاره به حوزه-های مختلف حریم خصوصی هم چون اعتقادی، جسمانی، اماکن، ارتباطات و اطلاعات، مواد 3 و 5 قانون حمایت از آمران به معروف را در سنجه شرع و قانون اساسی قرار داده است. ضمن تأکید بر این که عدم مشروعیت تجسس و ورود به حریم خصوصی شامل آن دسته از اقداماتی نیز خواهد بود که با هدف امر به معروف یا نهی از منکر صورت می‌گیرند، یافته‌های مقاله نشان می‌دهد که با توجه به اطلاق آیات و روایات امر به‌ معروف و نهی از منکر، وجوب فریضتین محدود به ترک واجبات یا ارتکاب محرمات به صورت علنی نبوده و در کلمات فقها نیز تفصیلی میان ترک یا ارتکاب مخفی و آشکار وجود ندارد. ازاین‌رو، به نظر می‌رسد قانون‌گذار در ماده 3 قانون حمایت از آمران به معروف، میان حرمت تجسس و عمومیت امر به معروف خلط کرده است.    }, keywords_fa = {امر به معروف,نهی از منکر,حریم خصوصی,تجسس,قانون اساسی}, url = {https://mag.rcipt.ir/article_146852.html}, eprint = {https://mag.rcipt.ir/article_146852_cf84bb1aa32140f1d459a59a8c671f7d.pdf} }
