One of these rules is the rule of social justice. Social justice is the most important index for the development of human life and it is considered as an important goal in Islam to establish it in society. In the Qur’anic texts and numerous traditions, justice is introduced as one of the goals of religion and of the divine Prophets. In this article, the writer deals with the concept and nature of social justice as one jurisprudential rule which is needed by the Muslim jurist in making inferences from legal injunctions (judgements). Discussions of the article will revolve around the fact that a Muslim jurist can make use of this rule as a primary judgement for the confirmation or disconfirmation of an injunction. He can also set it as a criterion and a measurement for verifying his inferences, in which case it will be dominant over other proofs. To establish the rule in question, references will be made to the proofs such as the QurÞÁn, tradition, reason and consensus and instances of its application in the deduction of religious laws in two respects (the source and origin of the deduction of laws and the criterion for the measurement of inferences (deductions) will be mentioned.}, keywords = {principle,Legal Principles,Justice,Social Justice}, title_fa = {بررسی فقهی قاعده عدالت اجتماعی}, abstract_fa = {فقیه برای استنباط احکام شرعی خصوصاً در این عصر که با پیچیدگی‌ها و مسائل مستحدثه خاصی روبرو است، نیازمند یکسری قواعدی است تا در استنباط، از آنها کمک گرفته و آنها را به‌عنوان معیار و میزان صحت و سقم فتاوای خود قرار دهد. یکی از آن قواعد، قاعده عدالت اجتماعی می‌باشد. عدالت اجتماعی مهـمتـرین شـاخص ارتقای حیات بشری بوده و برقراری آن یکی از هدف‌های مهم اسلام است. عدالت در نصوص قرآن کریم و روایت‎های فراوان به‌عنوان هدف و مقصد دین و انبیا معرفی شده است. ما در این نوشتار به بررسـی مفهـوم و ماهیـت عـدالت اجتماعی به‌عنوان یک قاعده فقهی که فقیه در استنباط حکم شرعی بی نیاز از آن نیست، خواهیم پرداخت. بیان خواهد شد که فقیه؛ هم بصورت حکم اولی می‌تواند از این قاعده برای اثبات یا نفی حکمی استفاده کند و هم به‌عنوان معیار و میزان برای سنجش صحت و سقم استنباط‌های خود که در این صورت بر ادله دیگر حاکم خواهد بود. برای اثبات این قاعده به دلایلی از جمله کتاب، سنت، اجماع و عقل استناد خواهیم کرد و نمونه‎هایی از کاربرد این قاعده در استنباط احکام را در دو محور (مصدر استنباط احکام و معیار سنجش استنباط) ذکر خواهیم کرد. واژگان کلیدی}, keywords_fa = {قاعده,قواعد فقهی,عدالت,عدالت اجتماعی}, url = {https://mag.rcipt.ir/article_99605.html}, eprint = {https://mag.rcipt.ir/article_99605_bcf70306444b5878bf47703799c736ce.pdf} }
