The Islamic state is meant any form of sovereignty over Islamic societies which is exercised by a just ruler, whether be the infallible Imam or anyone else. Although the transmitted reports (traditions) from the Prophet Muhammad and Infallible Imams regarding the subject in question and certain statements by faqihs apparently indicate that rebellion is to be restricted to the Infallible Imam, the rulings regarding the rebellious groups can also be extended to include rebels against a Muslim jurist, drawing upon a number of arguments and certain evidence.  The Islamic state, prior to any military operations against rebels, must take steps in making them follow the Islamic state and present them with an ultimatum. However, in case these acts prove to be ineffective, having resort to the military and the police to suppress them is not only allowed but also obligatory.  The rebels are not taken to be disbelievers and hence when they are killed, the same funeral ceremonies are held for them as are done for Muslims, and their wives and children are not taken captive. The present article has used an analytic-descriptive method in dealing with the subjects in question.   }, keywords = {Islamic state,rebels (bughÁt),governmental fiqh}, title_fa = {مفهوم شورش و شورشی و چگونگی رو در رویی دولت اسلامی با شورشیان از منظر فقه}, abstract_fa = {از نگاه فقه، شورشیان به کسانی اطلاق می‎شود که فراتر از نقد و انتقاد، بر ضد پیشوای عادل مسلمان، قیام نمایند و بر علیه دولت اسلامی وارد جنگ شوند و یا تحرکات خشونت‎آمیز، به مقابله و معارضه با آن بر خیزند. مقصود از «دولت اسلامی» هرگونه حاکمیتی است که توسط حاکمی عادل؛ اعم از معصوم و یا غیر او بر جوامع اسلامی اِعمال شود. گرچه سمت و سوی مستقیم روایات وارده در این باب و نیز ظاهر عبارت‎هایی از فقها، شوریدن بر امام معصوم7 است، ولی با تکیه بر دلایل و شواهدی چند، می‎توان احکام مربوط به این گروه را بر شورشیان بر ولی فقیه نیز تعمیم داد. دولت اسلامی، پیش از هرگونه اقدام نظامی و انتظامی، باید این گروه را ارشاد و راهنمایی کند و با آنان اتمام حجت نماید و در صورت بی‎تأثیربودن این کار، مقابله انتظامی و نظامی با آنان جایز، بلکه واجب خواهد بود. ایشان در زمره کافران محسوب نمی‎شوند و لذا احکام غسل و کفن و نماز، بر کشته‎های آنان جاری است و زنان و کودکانشان به اسارت در نمی‎آیند. بحث این مقاله، به شیوۀ تحلیلی ـ توصیفی دنبال خواهد شد.}, keywords_fa = {دولت اسلامی,شورشیان,بغاة,فقه حکومتی}, url = {https://mag.rcipt.ir/article_89961.html}, eprint = {https://mag.rcipt.ir/article_89961_7c790bfcc5ea03a1e3503b905652ec05.pdf} }
