Preserving borders in the Islamic political system is of great significance. There exist Qur’anic verses and traditions in Islamic doctrines that directly ask Muslims to preserve borders (frontiers) of Muslim countries. ImÁmiyyah or Twelvers’ figh attaches great importance to border guards and maintenance of Muslim territories. However, despite the eminent position of border guards in the political system of Islam, the issue in question has remained a jurisprudential rule at the level of a recommended one. However, in view of the wide-ranging and important discussion of border guards in Islam, the issue can be discussed as a jurisprudential rule. From among the cases where a qualified competent Muslim jurist can exercise his authority in enacting laws is the use of ‘jurisprudential rule’. The important feature of this jurisprudential rule lies in its wide application. With this jurisprudential rule in hand, various issues can be tested against this rule which, in turn, helps to discover the desired legal prescript (judgement) in the least possible time. Drawing upon the descriptive-analytic method and based on the Qur’anic, traditional, rational sources as well as jurisprudential discourses, in this article an attempt has been made to stablish the fact that protecting borders (border guards) is considered obligatory in the ImÁmiyyah jurisprudential system and to cast light on the discussions raised on the rule of border guards of Islamic countries.}, keywords = {border guards,Islamic Government,ensuring security of borders,border guards in ImÁmiyyah jurisprudence}, title_fa = {قاعده‌انگاری حفظ ثغور مسلمانان در حکومت اسلامی}, abstract_fa = {مطالعات علوم سیاسی، حاکی از آن است که توسعه در جامعه منوط به تحقق امنیت؛ اعم از مرزهای خاکی، آبی و هوایی است. محافظت از مرزها در نظام سیاسی اسلام از اهمیت به سزایی برخوردار است. آیات و روایاتی در آموزه های اسلامی وجود دارد که مستقیماً دستور به صیانت از مرزهای مسلمانان می دهد. اهمیت مرزبانی در فقه امامیه مشهود است. لکن علی رغم جایگاه ویژه مرزبانی در نظام سیاسی اسلام، موضوع مرز در فقه امامیه در حد یک حکم فقهیِ غالباً مستحب باقی مانده است. اما ناظر بر گستردگی و اهمیت بحث حفظ مرزها در اسلام، می‎توان این موضوع را در قامت یک قاعده فقهی بحث کرد. از جمله مواردی که در دست فقیه جامع الشرائط به مثابه ابزار وضع حکم کاربرد دارد، استفاده از «قاعده فقهی» است. ویژگی مهم قاعده فقهی به دایره شمول آن باز می گردد. با دردست-داشتن قاعده فقهی، می توان مسائل مختلف را بر این قواعد، عرضه و تطبیق کرد تا سریع-تر به کشف حکم شرعی رسید. در مقاله حاضر تلاش شده است، مبتنی بر روش توصیفی ـ تحلیلی و بر اساس منابع قرآنی، روایی، عقلایی و کلام فقهی، علاوه بر اثبات وجوب مرزداری در نظام فقهی امامیه، به «قاعده‌انگاری حفظ ثغور مسلمین در حکومت اسلامی» پرداخته شود.   }, keywords_fa = {حفظ ثغور,حکومت اسلامی,امنیت مرزها,مرزبانی در فقه امامیه}, url = {https://mag.rcipt.ir/article_139951.html}, eprint = {https://mag.rcipt.ir/article_139951_69660f36498a25df33ff4a06131dec54.pdf} }
