Nobody alone can cope with natural events such as floods, earthquakes, and epidemic diseases like Coronavirus disease. To cope with them, firm decisions must be made and all governmental facilities should be made use of. The question arises whether the Islamic government undertake responsibilities and perform its duties in these conditions or not. Or the case may be that fiqh does not place any responsibility for these things on the government. According to a set of traditions (riwÁyÁt), it is incumbent upon everybody, including members of the government, to make all their efforts to take care of Muslims’ affairs and resolve their problems. As some Muslim jurists (fuqahÁ) have explicitly stated, taking care of the general affairs of the Muslims are intended by the traditions, and in view of the fact that in the case of social or natural events, Muslims are in more need of help than any other time, they cannot be helped but by their government. Furthermore, regarding the fact that the measures taken by the state are definitely part of the public interests, according to the principle of expediency in Islamic fiqh, the government should assume responsibilities for ensuring public interests.}, keywords = {governmental jurisprudence,governmental authorities,calamities,natural calamities,epidemic diseases}, title_fa = {واکاوی فقهی مسؤولیت حکومت در بلایا و بیماری‌های واگیردار}, abstract_fa = {  بلایای طبیعی و برخی بیماری‌های واگیردار، قدمتی به پهنای تاریخ بشر دارد. مقابله با برخی حوادث اجتماعی و علاج آن؛ مانند سیل، زلزله و بیماری‌های همه‌گیر نظیر کرونا، تنها از عهده افراد بر نمی‌آید و نیازمند تصمیمات کلان و امکانات گسترده است که در اختیار افراد نیست و باید از اختیارات حکومتی و ابزارهای در اختیار آن بهره برد. اما آیا حکومت در این شرایط، وظایف و مسؤولیت‌هایی را بر عهده دارد، یا فقه هیچ مسؤولیتی را متوجه حکومت نکرده است؟ بر اساس طایفه‌ای از روایات، اهتمام به امور مسلمین و دفع ضرورت از آن‌ها بر همگان از جمله حکومت لازم و واجب است. همان گونه که برخی از فقها تصریح کرده‌اند، با توجه به قرائنی، به نظر می‌رسد امور عام مسلمین مراد روایات است و با توجه به این‌که در حوادث اجتماعی بیش از هر زمان دیگری مسلمین نیاز به کمک‌رسانی دارند، این امر جز از حکومت ساخته نیست. هم‎چنین با توجه به این که اقدامات دولت جزء مصالح قطعی جامعه به شمار می‎رود، بر طبق عنصر مصلحت در فقه، وظایف و اختیاراتی بر عهده حکومت است. }, keywords_fa = {فقه حکومتی,اختیارات حکومتی,بلایا,بلایای طبیعی,بیماری‌های واگیردار}, url = {https://mag.rcipt.ir/article_139949.html}, eprint = {https://mag.rcipt.ir/article_139949_92a91730732ba35ab777ec134a60e072.pdf} }
