Taking into account the jurisprudential sources, it seems at first glance that the hoarder is forced by law to sell the stored items and if he does not sell them at fair prices, the religious authority (hakim-e sharÝ ) places a price on them. However, the available jurisprudential sources have rarely dealt with the idea of the punishment of a hoarder. After the Islamic Revolution of Iran won victory and the Islamic government was formed, there was a tendency that under certain conditions, a hoarder should be recognized as “corrupter on earth”, or mufsid fi’l arÃ, to use the term in Islamic jurisprudence. The present research, having relied on the article 286 of the Islamic penal law ratified in 1392 in the Islamic Republic of Iran, seeks to describe and analyse the concept of corruption on earth as applied to one who is a hoarder. The research has come to the conclusion that a hoarder not only is at first faced with the force to sell at the fair price the items he has stored and pay a heavy fine, but he may also be sentenced to capital punishment if he is proved to intend to throw the Muslim community into a state of economical chaos and imbalance.}, keywords = {corruption on earth,criteria of corruption,hoarding,hoarder,punishment of a hoarder}, title_fa = {امکان سنجی تطبیق افساد فی الأرض بر احتکار مایحتاج عمومی مردم}, abstract_fa = {احتکار از جمله رفتارهایی است که خصوصاً در زمان هرج و مرج‌های اقتصادی شدت گرفته و در شرایطی، نظام معیشت جامعه را مختل می نماید. با ملاحظه منابع فقهی، در ابتدای امر، محتکر ملزم به فروش می‌گردد و اگر در فروش، قیمت عادله را رعایت نکند، حاکم شرع اقدام به قیمت گذاری کالا می‌نماید. لکن به ندرت در منابع فقهی به مجازات محتکر پرداخته شده است. بعد از پیروزی انقلاب اسلامی ایران و با تشکیل حکومت اسلامی، این تمایل به وجود آمده است که محتکر، با تحقق شرایطی، به عنوان مفسد فی الارض شناخته شود. پژوهش حاضر با معیارقراردادن ماده 286 قانون مجازات اسلامی، مصوب 1392، به توصیف و تحلیل مفهوم، جرم‌انگاری و معیارهای فساد فی الارض پرداخته، سپس با بررسی احتکار، افساد فی الارض بودن آن را مورد واکاوی قرار داده است. در نهایت به این نتیجه دست یافته است که در ابتدای امر، محتکر تنها با الزام به فروش و قیمت گذاری کالا و جریمه نقدی مواجه می گردد. لکن با تحقق شرایط افساد فی الارض، خروج زندگی مردم از حالت تعادل و اخلال شدید در نظم عمومی جامعه، محتکر، حتی می-تواند به اعدام نیز محکوم گردد.}, keywords_fa = {افساد فی الارض,معیارهای افساد,احتکار,محتکر,مجازات محتکر}, url = {https://mag.rcipt.ir/article_110612.html}, eprint = {https://mag.rcipt.ir/article_110612_51dcdc54fcae232997b29b5cc46d60cc.pdf} }
